These Terms of Service (the "Terms") form a binding agreement between you ("you," "your," or "Subscriber") and KINETIC ("KINETIC," "we," "us," or "our"). By creating an account, starting a free trial, or using the KINETIC platform (the "Service"), you agree to these Terms. If you do not agree, do not use the Service.
KINETIC provides a subscription-based software platform designed for gymnastics coaches and gymnastics-program operators. The Service includes (without limitation) a USAG- and Xcel-aligned skill library, tiered season lesson plans, a drill bank with deduction-tied coaching cues, a class planner, a routine library, and (where applicable) team roster, attendance, and athlete-tracking tools.
To use the Service you must create an account using a valid email address and a password of at least six characters. You agree that the information you provide is accurate and that you will keep it current. You are responsible for all activity that occurs under your account and for keeping your credentials confidential. Accounts are for use by a single individual; sharing logins across coaches or staff (other than as expressly permitted on the Team plan) is prohibited.
KINETIC is offered on monthly subscription plans. The current plans are:
All new subscriptions include a 30-day free trial. We will collect your payment method at signup but will not charge you until the trial ends. After the trial, your card will be charged automatically at the start of each billing period unless you cancel.
Payments are processed by Stripe, Inc. ("Stripe"). By providing a payment method, you authorize us (through Stripe) to charge that payment method for all amounts owed under your subscription, including any applicable taxes.
You may cancel your subscription at any time from the "Manage Subscription" link inside the Service (which opens the Stripe Customer Portal). Cancellation takes effect at the end of the then-current billing period; you will retain access until that date. We do not provide pro-rated refunds for the unused portion of a billing period.
If you believe you were charged in error, contact us at support@coach-kinetic.com within 30 days of the charge. We will review refund requests on a case-by-case basis.
You agree not to (a) use the Service for any unlawful purpose; (b) attempt to access another user's account or data without authorization; (c) reverse-engineer, decompile, scrape, or otherwise attempt to extract our underlying content (including the skill library, lesson plans, drill bank, and references to USAG materials) for resale or redistribution; (d) upload viruses or malicious code; (e) interfere with or disrupt the Service; or (f) use the Service to harass, abuse, or harm another person.
We may suspend or terminate your account at any time if we reasonably believe you have violated this section.
The Service and all content provided by KINETIC — including the skill library entries, drill descriptions, lesson plans, mantras, cues, illustrations, code, and branding — are the property of KINETIC or our licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use this content solely for the operation of your own coaching activities for the duration of your subscription. Nothing in these Terms transfers ownership to you.
Content you upload (such as class notes, athlete information, routines, sticky notes, or videos) remains yours. By uploading content, you grant us a worldwide, royalty-free license to host, store, and display that content as necessary to provide the Service. We do not sell your content or use it to train third-party AI models.
The Service is provided "as is" and "as available." To the maximum extent permitted by law, KINETIC disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, reliability, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that the content will be free from inaccuracies.
To the maximum extent permitted by law, KINETIC, its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation lost profits, lost revenue, lost data, business interruption, or athlete injury, arising out of or related to your use of the Service. In all cases, our total cumulative liability for any claim arising from these Terms or the Service is limited to the greater of (a) the amount you paid us in the twelve months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
You agree to defend, indemnify, and hold harmless KINETIC and its officers, employees, agents, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of (a) your use of the Service; (b) your violation of these Terms; or (c) any injury or claim by an athlete, parent, or third party arising from your coaching activities.
You may terminate your subscription at any time as described in Section 4. We may terminate or suspend your account immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service ceases. We may retain certain information as required by law or for legitimate business purposes (see our Privacy Policy).
We may revise these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Material changes will be communicated by email at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance.
These Terms are governed by the laws of the State of Utah, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service shall be brought exclusively in the state or federal courts located in Salt Lake County, Utah, and you consent to the personal jurisdiction of those courts.
